Apple Files Lawsuit Against 10 Samsung Smartphones
Apple isn't giving up its fight against Samsung and its Galaxy line of tablets and smartphones.
It's been a while since we heard anything relating to a Samsung/Apple lawsuit. Last we heard, Samsung had won the right to sell the Galaxy Tab 10.1 down under and was using Apple's relentless efforts to block its sale to boost marketing for the device. However, it seems though Samsung won that particular battle, the war rages on.
Bloomberg reports that Apple has just filed a lawsuit aiming to block the sale of multiple Samsung-brand smartphones in Germany. The lawsuit covers ten phones in total, including the company's successful Galaxy S Plus and S II handsets. The suit was filed in Dusseldorf and is alleging patent infringement of Apple's design rights.
Samsung was recently forced to introduce a modified version of the Galaxy Tab 10.1 in Germany after Apple claimed that the original model was too similar to its iPad tablet. The result was the Galaxy 10.1N, which was introduced after sales of the original version were blocked. Apple tried to have this model blocked too, claiming that it was still infringing upon Apple-owned patents. However, in December, Judge Johanna Brueckner-Hofmann said in a preliminary assessment that the courts believed Samsung's changes were sufficient.
"According to the court's assessment, the defendant has moved away sufficiently from the legally protected design," Judge Brueckner-Hofmann is quoted by Reuters as saying. A ruling is expected on February 9.

no i get it, they basically made the tablet market, i know they didn't invent it, but they made the tablet appealing to people that mas producing a tablet is now a realistic venture, apposed to previous attempts that were... well... lack luster and easily forgotten.
imagine you made something, and than other people coppied you (yea i know, but for the sake of this argument, dont go there) and there was next to nothing you could do... what would you do, give them a hug and say awesome, competition. or would you try to stop them by any means necessary?

Steve Jobs claim that the Android operating system is stolen from Apple and no one should be allowed to use it is the equivalent for saying that no one should be allowed to drive a car because you invented the steering wheel.
It's a good thing Steve died before his biography was published because it really proved that he was as obsessive, controlling and crazy as we thought he was.

No what Apple did, and does, is took a already existant product and made it trendy. Their iPods were inferior in many ways to Creatives Zen series. In fact Apple copied Creatives GUI like interface idea which Creative sued and won. Nothin in any of Apples products is original in any way. They just know how to appeal to the masses while sucking every last penny possible out of them. Its like the iPhone 4S. No 4G, normal glass, and locked doen like crazy. Compare it to any of the current high end Android devices, all that have 4G, Gorilla Glass and open.
As for someone copying, there will be an idea and then there will be similar ideas. What I find offensive in all of this is that the courts took Apples doctored photos into evidence at all. That alone is a mistrial.
Plus look at it from Samsungs side, Apple has long been using Samsungs CPU for their modile devices in what looked like a good partnership. Then Apple turns around and sues Samsung. It would be like Apple suing Intel for something, which I wouldn't be suprised if they do at some point.
In short, Apple has become nothing more than a patent troll. I understand patenting an idea, like x86 or such but Apple is just full of it.

What they did, is make a giant mp3 player with limited internet access, then using marketing managed to sell them by the droves. Sadly most the people that bought them still don't know how to use them, or what they should use them for. Sadly most humans are "Sheeple" (XKCD) and are just following the herd instead of thinking for themselves.
Apple is a bunch of pu55ies that don't want to compete in a fair and open market.
They want to monopolize the world of communications and entertainment and and keep every man, woman and child on their digital leash while price gouging their end consumers and screwing software developers and their "partners". They provide a heavy blanket of oppression and a complete lack of freedom to their users and devs alike.
While the blind unknowingly subscribe their soles to this cult the few with eyes must try to make a difference; to keep the legions of blind followers informed. Though it may be hard to do this because most of the sheep have already drank the cool-aid and are now possessed, I will do my best to always promote the truth, capitalism and a fair and open market where Competition and Choice still have life.

As much as I'd LOVE to see a boycott on Apple software and devices, I don't see it making a huge effect if it's just Tom's users. Everywhere I look I see the ratio of iPhones to Androids 3:1, and if you include iPods that's a ratio of 5:1. Apple products are used by the second and it would take a year or two to bring it to turtle pace, if even. The least we can do it stop buying their products. Something I never have, and never intend on doing.

If this was 2006, I'd offer Blackberry. If it was 2009, everyone would yell at you to choose the iPhone. It's 2012, go for Android.

Google should use its Motorola patent powers to block Apple from selling any mobile phones. Samsung is a biggest player in Android market. Make perfect sense for Google to protect its biggest partner. We need Iphone to go with Steve Jobs.

1 - The iPods were superior in many ways, in many peoples opinions, to the Creative Zen series.
2 - Does the fact Creative sued when someone blatantly copied their design make them a patent troll too? Or is it only allowed.... 2 times? 3 times? How many times are you allowed to try and protect your intellectual property rights, in your opinion?
3 - 'Nothin in any of Apples products is original in any way' - this statement I cannot take seriously. You can dislike Apple but when you overstate your case it lessens your credibility.
4 - 'They just know how to appeal to the masses while sucking every last penny possible out of them' - isn't this the definition of a very successful company? Appealing to the masses is a good thing, by the way. As for 'sucking every last penny' - if their products were overpriced, they wouldn't be best sellers.
5 - You mention no 4G in the iPhone 4S, and 'normal glass', and also 'locked down'. Lets remember that for more than 50% of the world, the HDSPA implementation in the iPhone 4s is actually faster (since there is no 4G in lots of places, for example in the UK) than any 4G implementation in any Android phone, and of course battery life is better. Lets also ask how many people prioritise 'gorilla glass' when buying a phone? Then, lets consider your 'open' argument, since the source code to Android 3 wasn't released. You can, of course, jailbreak your iPhone too. So where's the tangible benefit for this vague claim of 'open'?
6 - The legal system is responsible for disregarding 'doctored photos' if that doctoring materially affects the case. Not Apple.
7 - The fact that Apple has been long been using Samsung as one of its many suppliers to manufacturer Apples custom designed CPU does not give Samsung any rights to copy anything, or any right to not be sued. Indeed, turn it around, given the long standing relationship, Apple being one of Samsung's biggest customers, isn't it completely immoral that Samsung uses that inside knowledge to develop a near-identical range of similar products? As it happens, Samsung will probably regret this because even if the legal case doesn't succeed, Apple will now find alternative manufacturers (and has already started moving away from Samsung).
8 - There is no such thing as a 'patent troll' - if Apple have not even an arguable case, they'll have to pay their own legal expenses and the expenses of their opponents, and will not even gain a preliminary injunction, so it would simply cost them money. In that respect, it's a self regulating industry. Note, I am not passing any opinion on who should win such legal cases - I'm simply saying the legal system can look after itself - and if not, that flaw lies with the legal system, not with Apple.

By the way, the iPods came out long before the Zen series (Zen October 2002, iPod October 2001), and there were patent infringements on both sides, with apple filing 2 legal suits against Creative.
The end settlement involved a financial payment on Apples side and Creative joining the "Made for iPod" accessory program. No cases were 'won'.
