Wolverine Pirate Calls Charges ''Ridiculous''

Wolverine flick pirate speaks out in regards to the charges.

Last week, the FBI arrested 47-year-old Gilberto Sanchez in his Bronx, New York home for uploading an unfinished copy of X-Men Origins: Wolverine back in April. Sanchez allegedly stored Wolverine online at Megaupload.com where fans downloaded and viewed the movie 4.1 million times. Set for a May release, the pirated film lacked CGI effects and displayed stunt cables.

Currently Sanchez is out on $50,000 bond. However, if found guilty, Sanchez will face a $250,000 fine and up to three years in prison, or twice the gross gain or gross loss attributed to the offense, depending which is greater. But Sanchez apparently thinks it's all crap. In fact, he told the New York Daily News that the charges against him are "ridiculous."

"I bought it from a Korean guy on the street for five bucks," he said. "Then I uploaded it. I didn't make any money." He also added that he's into music, and didn't think much about uploading the movie to Megaupload.

Last week the indictment said that Sanchez, under various aliases, willfully infringed the copyright of a copyrighted work by distributing a "work being prepared for commercial distribution." It also said that Sanchez knew that the work was intended for commercial distribution.

Forget the law: we say that Wolverine just needs to tickle his funny bones with those adamantium claws. Let's go. bub.

If I were him, I'd add that the charges should be dropped for the sake that it was a terrible movie.

@shamgar Crysis jokes will live on no matter what the haters say. This one however was a bit of a stretch... Maybe break up the monotony with: "Will it blend?" or anything "I can has..." related. :D

On topic: Is Sanchez lying? Was he at all involved in the Wolverine film? (How else could he have gotten a copy?) Why do I doubt the existence of "Korean Guy" and the alleged $5 transaction?

In a way i think the RIAA and MPAA have gotten out of hand with the lawsuits, but it very obvious that this guy is into pirating all types of goods based on the fact that he's into music and megaupload.com, those 2 together means he probably more than guilty or alot more charges. If they dig into it deeper they will probably find he has like 1000's of songs also on the net for distributions illegally.

Per the comment on that he had to be involved in the film to have access to it pre release, that is nonsense. My ex brother in law is into buying these cheap pre release dvd's and its surprising whats out there if you look for it. Movie producers ultimately are to blame for hiring people who leak it to begin with, so maybe the movie industry needs to take some accountability into their own hands and find just who are the dicks allowing this to happen in the first place, without a insider leaking them, there would not be a pre release copy in circulation.

He got in a lot of trouble because he PROVIDED the upload/download. If you are just the downloader/whatcher they don't care as much about you. I want to get the dealer not the addict.

So it's wrong to steal money but it's okay to burn money? Because, hey, he didn't make any money out of it!

The punition is harsh, but the law is indeed the law. I don't care much when I see the FBI warning at the beginning of a movie, but it does say fines can reach $250 000. My guess is they want to make an example out of him to scare the others into doing the same thing.

The ironic part is the movie made more money because of being leaked than it would have otherwise due to the huge amounts of publicity it created at the time.

Sorry but there is a valid excuse he could use, I'm not going to say it but his reasoning is pathetic. If you wanted to get away with a crime you have to be more creative and come out guns blazing unlike this guy who is probably pissing himself thinking of 3 years and a swollen buttocks. Who cares about the fine, thats what I would be concerned with.

What really makes me laugh is the MPAA/RIAA are idiots and purposely go after the easy guy who really has nothing to do with stopping piracy just to prove a point to the public. Its a scare tactic. Attack the weak and make the strong look like assholes. In this case "The Scene" is strong like a Rhino and you average pirates are the weak taking the blame. They know this guy has nothing to do with its spread because I know for a fact he wasn't the original person that leaked it. I actually hope he gets a harsh penalty only for the simple fact it will make the Anti-Piracy Gestapo look like the bastards they are.

it doesn't matter if you idiots think the movie sucked with your bad taste in anything. the fact is the movie caused damages because it released an unfinished movie that gave away the story of a movie they planned on releasing

do you think lord of the rings would have done as good as it did if someone released an unfinished version of that all over the net? or if someone was able to do this kind of thing before the empire strikes back giving away the shocking part of finding out Vader was Luke's father?

this guys is just saying anything to try to win the case just like any of you losers would do in his position

Dummies, they're lucky they got 85 million the first weekend. That's more than what Avatar took in, at 73 mil. The leak probably pushed it, then the movie killed it. Because after the first week it declined big time. Because the movie sucked Adamantium balls.

The movie still made profits so there was NO damages. Where is the proof of damages?

There is also these things out there called books and many of us had read Lord of The Rings long before it was released. We knew the story and saw it anyway.

Once again a lesson in economics guys. Just because you invest 1 Million Dollars into a project does NOT make it worth 1 Million Dollars. The market determines its worth. Idiots thinking there is no risk in investment is the reason why our market is in the condition it is in.

WTF? That is not the principle of Law. Law is to set right and wrong within society. However we now live in a society with so many lawyers that in order to keep these paracites feed they have to justify their existance by creating more and more pointless laws.

This is yet another joke of "the system" really if they want to send a message they need to have punishment that fits the crime, made available doesn't equate to distributed; It's high time that these types of cases should go to misdemeanor charges and realistic fines of $2000-10000. As for downloading, cost of item.

Oh, and the (final version of the) movie sucked.
Eventually, I will boycott movies and go back to reading books; but then again I'm just sticking it to one man, and giving to another.
Though I really cut down on my theater visits once I started reading movie reviews from Rotten Tomatoes.

Maybe studios should set up PayPal for donations from pirates who actually liked a movie that they viewed.
