Obama Contemplating Three-Strikes Piracy Law
President Obama is reportedly considering a three strikes law similar to what's already in effect in France.
Recently, France passed a 'three strikes' law that would see repeat pirates disconnected by their ISP. The law gives Internet users three chances before disconnecting them; the first time they are caught, users are sent a warning via email. Then, they receive letter in the post. Finally, if they are caught a third time, their ISP will terminate their connection, cutting them off from the Internet.
The Guardian reports that Hollywood lobbyists are pushing for a similar law to come into play in the United States. Inside information comes from Ari Emanuel, a co-chief of Hollywood's biggest talent agency and the brother of the White House Chief of Staff; Ari says the industry has been discussing tougher anti-piracy laws with President Obama outside of the public eye.
“We are in the midst of talking to the president and some attorney generals and [we are] trying to implement a three strikes and you’re out rule,” Emanuel said, according to the Guardian.
Emanuel's revelation was made at the Abu Dhabi Media Summit, where other industry heads also expressed their support for tougher piracy laws. James Murdoch claims piracy is no different to "going into a store and stealing Pringles or a handbag."
"We need enforcement mechanisms and we need governments to play ball … There is no difference with going into a store and stealing Pringles or a handbag and taking this stuff," said Murdoch. "It's a basic condition for investment and economic growth and there should be the same level of property rights whether it's a house or a movie."

This will not be very popular with ISPs. I don't think they will be happy with loosing customers.
Can we also apply the three strikes rule to greedy corporate *ssholes?
you can't control the internet.. sounds like China
More heavy handed policies from the White House Administration... More Big Brother.... More and more rules and regulations to make the horse blinders I'm forced to wear even bigger.
communist china? anyone?
if u use a private tracker ... use a forced encryption ... and download 10 terabytes a day ... they can't do crap about it ... next
Obama needs a bomb near him ....

How many times do I have to see the word "losing" incorrectly spelled?? It's not spelled "loosing"!

Although I don't like the guy at all. That's not the route to take.
Be closer to selling (or giving away) knock off handbags outside of the Gucci store rather than walking in there and stealing one. How many people who get the knock off would have bought the original otherwise?
Also you have those studies that show often people who download pirated stuff also spend higher than average. Cut their internet connection and you also cut them off from legitimate purchases (legal downloads, ordering CD's, DVD's, BluRays). Suppose it might lead to an increase in brick and mortar sales, but I wouldn't be surprised if widespread implementation of such a policy resulted in a noticeable decrease in legitimate sales. Especially with children getting their parents cut off and the like.

if u live in the states .... run .... cos in about 10 seconds.... the agency is gona be at ur door.... 5 ...4...
We're turning into an authoritarian style of Government.. sad to see people just rolling over and letting stuff like this happen all the time. Rights are disappearing day by day, as we cede control to the corporatocracy.
3 strikes, without any chance to refute the charges? can you say a violation of "due process of law"
I'm all for it. If you don't pirate (which you shouldn't) then there is no problem.
The only people who this affects are pirates, and I'm of the opinion that they should go to jail, because piracy IS a crime.
The movie industry is the only place where they can charge you four times for the same product. Once to watch a movie in the theater, once to rent it on dvd, once to buy the dvd, oh and once to watch it on cable! Everything is about profitability.

If you get caught the first or second time I can understand someone either hacked individuals router or a family member downloaded illegally without prior consent. But get caught a third time and I really think they deserve to get banned....imo

An interesting point, I have a feeling that such a law would cause an increase in hacked personal routers since ISP's would track based on modem information, or public IP address, they would have no ability to track and ban my little peentop's web activity unless they unlawfully install an agent onto my computer that transmits a unique identifier...unlawful now, but maybe not in the next few years if legislation like this gets passed...
I think it's a mess. What if your neighbor manages to break into your wireless router and DL a bunch of stuff?
If this does go through, then VPN or some other type of encrypted network would probably be used then. Then they would probably be back at square one, catching the least technically inclined while being unable to catch the biggest providers/seeders.
How about that policy with Obamacare?
What is in place now?
Don't we have some sort of two strike policy or something, where the first time your caught you only get a slap on the wrist?
I suppose that as long as you stay behind the "strike" curve you're fine. Obama adds one strike the next president adds another and so on.
This'll never fly... The Democrats were wailing about Patriot Act provisions and at the very moment, Republicans are screaming about how the current administration's spending levels are "mortgaging our children's future"...
In order for this to become law, Congress would have to approve funding to set up ANOTHER executive bureaucracy just to either A) monitor and/or otherwise ensure ISPs are enforcing this law or B) monitor and/or track individual American's internet habits and put pressure on ISPs to drop "offending" individuals... Either way, it'd be a massive expense slathered with a metric ton of government intervention... Any Democrats concerned with "individual rights" or Republicans concerned with "fiscal responsibility" voting for such a monstrosity, will be going on record as bein' hypocrites of the highest caliber...
They're havin' enough trouble gettin' Healthcare reform through, I imagine something like this will die on the vine...
Unless of course.... Obama issues an Executive Order... Tricky...
Well... this could be a plus even if you are a pirate. Right now if you are found to be pirating you go straight to court (assuming the recording industry draws your name out of a hat and takes action against you). With this new 3 strikes law, you would still have to be caught pirating as before but you get two warnings first. Unless you get the warning from the ISP and get taken to court by the music industry, hmmm....
As the administration has already finished providing healthcare laws that cater to the public, not the big insurance companies, and also has already solved the big budget deficit crisis, along with ending all the financial engineering that led us in this crap-shoot that we live in today, then off course they should direct their attention to this issue...
Oh, wait, none of the above has happened yet.
Just another attempt by big corp to mull some, and Ari's brother being at the White House is also very helpful. Talk about promoting own interests by using personal connections...
And yes, it will be put into law, because this administration has proven to be on corp's side all along.
Nothing new here.
And how exactly do they plan to 'catch' you?
The difference is "The Store" doesn't treat paying customers like shop lifters after they've made their purchase. "The store" also doesn't use tax payer money for their own security.
how about a ZERO Strike policy? I don't remember my momma telling me stealing was OK two times, but not the third! Really anyone found guilty once should be banned from the internet for life! :0)
Oh, and to those that think they can just encrypt their way out of things; simply put, you can't. You can make it harder for them, but ultimately if they want to find you they can. Don't let anyone convince you otherwise, they're just putting your ass on the line.
if i can't get my daily dose of pr0n then i'm going to become a serial killer.
Another silly plan hatched by the entertainment industry to shift blame and responsibility.

do u understand how much resources will go in to decrypting just 1 persons traffic, and even after that they still have nothing to prove it's you that was pirating (due to hackers). they will need a warrant to search ur hard drive and only then (if anything was found) is the pirate in trouble. (not to mention that all ur logs are protected by a private tracker overseas).
oh and remember u have to get caught 3 times now for anything to happen. u might as well get hit by lighting a few times then get caught from the above. and i'm going with lighting on this one.
