Apple Threatens Steve Jobs Doll Manufacturer

Not surprisingly.

M.I.C Gadget, producer of many apple product cases, stands and bags, recently produced an extremely popular and pricey Steve Jobs toy.

Unsurprisingly, Apple wasn't too happy about this.

Last week, M.I.C's website announced:

A few hours ago, we have just received an email from a law firm representing Apple.Inc. Apple has informed us that this phenomenal SJ action figure, has not consented to the use of Apple’s copyrights and trademarks, therefore they request us immediately to cease the marketing and sale of this figure. Here’s what the email has told us:

“Unauthorized use of a person’s name and/or likeness constitutes a violation of California Civil Code Section 3344, which prohibits the use of any person’s name, photograph or likeness in a product without that person’s prior consent…” bla bla bla…

So, all Apple fanboys, you are not going to get this phenomenal figure anymore. M.I.C gadget hereby apologizes to Steve Jobs, Apple.Inc, and their law firm for any inconvenience caused. For those of you who have successfully ordered this collection item, we will contact you.

P.S. Steve, can we apply for some trademark license to produce this phenomenal figure for all your Apple fans? A wild thought, maybe Apple can bundle this figure with an iPhone 4 purchase…

So for those of you who happened to grab one of these, congratulations on your new and rare collectible.

Well, Apple comes out with a lawsuit over something stupid again. I would've embraced it if that was me they were making, I'd have felt honored. :)

All they have to do is alter his appearance a little bit and then Steve is SOL, because that would fall under "freedom of speech/symbolic speech". Apple could not do anything about it except complain.

Well, if they were to alter the figure away from Steve's actual likeness, it would be completely legal. Usually that's done in the doll industry by increasing the size of the head, but unfortunately for them, they portrayed Steve's big head perfectly.

All I can say is if any gets one don't ever open the package and be sure to save it.
It will be worth a lot of money someday as a collectors item (Yes,even to laugh at).

Especially since it's not particularly insulting.

Now if it came with accessories like, say, half-eaten baby corpses, a pentagram base, or other such depravity, then sure, Steve himself could sue for libel. This one was made by fans for fans, so there's no room to whine about defamation.

If they removed all traces of Jobs' name and the Apple trademark from the figure, changed the likeness ever so slightly, and sell it as "The Magical Innovator" or something non-specific like that, they could probably get away with it. Small toy companies do that all the time- most Hollywood and many Chinese and Japanese action movie stars have an unofficial likeness out there.

The main issue really is the use of Apple and Jobs' names to sell this figure, both explicitly (by naming the sculpture) and tacitly (by selling it in a store that specializes in Apple gear). Outside of those things, Apple has no case.

I have been traveling back and forth from Saudi Arabia and Canada for business. i have Visited some temples in Bahrain. Now this is as i understand. The Muslim and Islams do not believe in pictures in religion. they believe that god does not have a face.

Steve jobs is not Muslim and never will be, his view and statement on the world is for personal growth only. Steve jobs does not want to be a public figure. if you did he would not be standing behind his apple every time something happens. Ex apple is suing for misuse of personal property. so wait are the suing for the use of Steve jobs face or the iPhone in his hand. If Steve wanted to be a public figure would he not sue under his own name not his company.
