Nokia Sues Apple Over iPad and iPhone Patents

- By - Source : Tom's Guide US

Nokia has a bone to pick with Apple over five patents.

With news that that iPad will be hitting international territories on May 28 also comes word from Nokia that it has today filed a complaint against Apple with the Federal District Court in the Western District of Wisconsin, alleging that Apple iPhone and iPad 3G products infringe five important Nokia patents.

The patents in question relate to technologies for enhanced speech and data transmission, using positioning data in applications and innovations in antenna configurations that improve performance and save space, allowing smaller and more compact devices.

"Nokia has been the leading developer of many key technologies in mobile devices" said Paul Melin, General Manager, Patent Licensing at Nokia. "We have taken this step to protect the results of our pioneering development and to put an end to continued unlawful use of Nokia’s innovation."

Apple has yet to respond.

Interesting. When stuff like this happens, THIS is the kind of solid proof flamers need. Not made up crap. Such a shame a company like Apple needs to steal technology.

As much as I like to see Apple getting a bit of their own medicine, many of these silly vague patents (using GPS in an app is patented?) and the ensuing lawsuits put a damper on the advancement of technology.

But still the worst offender is Apple itself. So enjoy it guys.

Karma is a *itch.

Obviously Nokia is not playing middle-field protecting Apples target's such as HTC, but its good to see that Apple cant get away with playing the "us v.s. them" game(including like now, when 'them' is everyone). Especially when they were so late to every game they have played lately.

And can i just say, of all the news about mobiles systems in general on this site, Nokia has never had the coverage it deserves in any field.

end rant.

dstigue has made my point for me - the first 4 were cheers for a patent suit that most on this forum would call patent trolling. However, I suspect attitudes change when you companies you don't like are targeted rather than the ones you do like.

If the rolls were reversed and Apple was suing Nokia, would everyone find the patents acceptable?

Since I am of the stance that IP laws are out of hand and can often stagnate development, I can't say I find Nokia's lawsuit a good thing. Yes, I recognize that some development would never happen if a company couldn't guarantee its millions of dollars invested won't generate it billions of dollars profit in the future - but how far should a company be allowed to go on its patents? Anyone outraged that the guy who made the iconic smiley face got nothing for it? Anyone send that guy a check and a letter saying "thanks for the smiley face? I'm not saying there shouldn't be IP laws, just that we need to really reconsider what you can patent. I mean, genes? (Not jeans.) You cannot patent a living organism, but you can patent every fricking gene they have individually and thus effectively have patented a living organism. Patent tax saving strategies, patenting a way to have RAM external and connected by a cable to a RAM slot, and so forth makes me think IP laws are out of hand.

Lets see, Apple patents touch screens decades after they were invented, dubs it multi-touch, then sues the crap out of people. Meanwhile, Apple lawyers were clueless that someone had already patented the "cell-phone".

dstigue :
This is ridiculous. More patent trolling. Obviously location based services were coming. And smaller antennae? Can someone patent that? I want the patent on the small jeans girls wear. Because I want the right to tell them they have to take them off immediately or pay a cost. And I don't accept checks.

Anything is possible when a company can patent an Apple ;P

Sounds like another stupid lawsuit that shouldn't happen, but Apple sues anybody and everybody they can for any reason, I hope Nokia wins this.

Hopefully Nokia wins. In gadget biz, Apple does nothing but steal technology from other companies and wrap it in pretty premium priced packages and sell them as their own "inventions". Apple needs to pay licenses like everyone else from the tech they use.

Intellectual property rights are government chosen monopolies...gov't choosing winners and losers. Who is anyone to tell me what I can do with my own resources? It's just information. If they own the physical silicon, then it's their right to say what to do with it, but if the silicon belongs to me, then who ethically has a right to tell me in which way I cannot arrange it?

Property rights evolved as a way to manage LIMITED resources. Information and ideas have no limitation at all and any such attempt to limit them is immoral and authoritarian by nature. You cannot control intellectual property cronyisn without controlling the people.

Apple is probably a little concerned. They're so used to getting sued they only have Attack Tie Fighters in position and completely forgot to set up some turret defense systems.

I think it's more of a "stop being a bully" tactic, they were fine with others using this stuff but once Apple turned bully and went after HTC to try and stop them Nokia is doing the same to them. That seems the reason why they picked Apple and not the other phone companies, since the rest are not playing these stupid little lawyer games to stop a company from bringing out a product that could be better then theirs. It's a way of showing Apple they aren't the only ones who has attack lawyers and to stop while they are ahead.

I'm not a fan of patent trolling, and the current patent system is hurting technology more than it is helping it. With that being said, I'm pleased to see Apple getting a dose of their own medicine.
