Microsoft Suing BitTorrent Tracker for $43M

Microsoft is going after the operator of a BitTorrent tracker and over 100 of its users.

Microsoft has filed a copyright infringement lawsuit against LinkoManija and its alleged operator, Kestas Ermanas, for $43 million in damages. According to TorrentFreak, LinkoManija is the largest BitTorrent file-sharing tracker site in the Republic of Lithuania, a country in Northern Europe. Microsoft will be assisted by the local anti-piracy organization LANVA in its case against Ermanas and his company.

The lawsuit, filed in the Vilnius Regional Court, alleges that Ermanas and his company facilitated copyright infringement of Microsoft Office and 2007 through their involvement with the BitTorrent tracker. Although Microsoft has requested $43 million, Lithuanian law stated that Microsoft can only receive up to $53,000 in damages at maximum.

TorrentFreak contacted the defendant who in turn said that Microsoft was suing the wrong people. "We were told that as of 2010, he and his company no longer run LinkoManija," BitTorrent said. "Kestas and his company operated the site until December last year." Ermanas also told the site that he offered to resolve the issue by removing the infringing files, however Microsoft never responded.

In addition to Ermanas, Microsoft is also pursuing users of LinkoManija. Over 100 downloaders were reported to the police last November, and is scheduled to go to trial next month.

Information is free, but work is not and it should be rewarded. There is work behind any product and software is no different. Maybe you should try work sometimes...

I'd sure like to know what you do for a living...
let me guess.. nothing?

I put as much work into coding all day at a games company that any brick layer would, or customer service rep, ect.

its hippies like you that put me off open source in general!
(on that note, why don't you get open office if you care so much?)

scientists spend there entire lives making some breakthroughs that radically change the world for the better, are you saying their work is worthless?

i can say that almost 80 % off ppl are pirates in lithuania. you ask why? imagine average salary is 660$/month and not all get so much, minimum is 240$/month. And even hardware cost a lot more that in USA, f.e. i5 750 255$. Only companys use legal software, other individuals uses pirated windows, except they get legal software with laptop...We have no chance to spend so many money on softwares and hardware so we pirate :)

A lot of people in developing countries use pirated software only because it is so easy to get it. It is generally not considered a crime by public and open source is very unpopular. I think such trials could make at least one good thing - teach people that there is more to life than just pirated Microsoft products (Linux, OpenOffice...). And even if Microsoft is an absolute must, then it is not so expensive in relation to the whole PC cost...
I lived in Lithuania for a long time, so I know the situation...

I would disagree. Even basic software counting OS, office, Antivirus can easily get more expensive then whole computer hardware.
Maybe companies like Microsoft should consider reduced pricing for countries where majority cant afford it instead of suing.
If you pay your 1-2 years savings you are not going to spent another 6-12 months saving for BASIC software.
And with linux, I bet you find even less people capable to use it when they barely work with windows as unfortunately its not something you could learn in elementary or high school.

I work my ass off. I barely managed to pay rent this month. I ripped office 2003 and 2007.
I also legally own 4 copies of XP and two copies of Win7.
I think I've paid enough.
I will support whichever companies I choose to.

I believe I can see the point of this scenario, btu I still believe Microsoft should back down.
However, they have the muscle and power that they could easily do a lot worse. This is just a slight flex of their muscle to remind people. How about Win7 having over 1% market share before its official public release date? You can't tell me that most of them have MSDN or partnership licenses etc. Microsoft let people have Win7.

This way Microsoft is going to kill itself. Everybody knows that Microsoft´s Windows and Office solutions dominates the market because of the home user piracy. By fighting against piracy Microsoft is openning the doors for free software, like Linux distributions or OpenOffice. I´m against piracy, but I think Microsoft is going to loose market, because there are a lot of people in the world that can not and will not pay for Microsoft software.

I can't act all high and mighty, i've torrented, a fair bit too. I understand the need to earn moeny to keep producing what they're producing, but the only products i have legally bought are ones that i get student discounts for. Win7 for £30 was great, and if every software manufacture did nice student deals like that, i'd have a fully legal computer. However, the lack of job, and need of product for my course means i have to resort to torrenting. What makes me feel better is that even my college has pirated software (To be fair, the principle is a jerk and the IT course is seriously underfunded.)

You fool, you could have saved that money by going OpenOffice.org and supporting them.
Instead of a bad company that does very questionable things/tactics to get a hand on the market.

Only reason I have a legit copy of Windows 7 is because they sold it to college students for $30 bucks...lol
