Samsung Accused of Ripping-Off iPad in Australian Court
If they can find a way to sue each other in Antarctica, you can bet they'll do it.
If you're thinking that the global fight between Samsung and Apple over patents related to tablets and smartphones is beginning to resemble the 7 Years' War, you're right. We've already seen dueling complaints of patent infringement filed in European courts, with Apple managing to block sales of Samsung's Galaxy tab 10.1 in Germany and getting a similar preliminary decision in a Dutch Court. And of course, South Korea-based Samsung has moved to block iPhone 5 in Korea. But if all of that wasn't enough, their tit-for-tat battle has become tat-for-tit thanks to the Coriolis effect, as they've expanded their battle into the Australian court system.
In August, Apple took Samsung to court in New South Wales alleging that Galaxy 10.1 violated several Apple patents connected to iPad; Samsung countered that Apple's accusations were based on Galaxy Tabs sold in the US, not those sold in Australia. They presented 3 different models which differed considerably from US versions, prompting Apple to accuse Samsung of removing the offending components ex post facto. Shortly thereafter, Samsung returned the favor with a counter-claim that Apple's iPhone and iPad violate their own patents. Earlier today, Apple responded with a slightly pared-down case, limited to three elements they allege infringe on their patents: multi-touch features, the design of the touchscreen, and the Galaxy Tab's 'heuristic' capabilities. They also claimed that Galaxy Tab's white and yellow packaging is designed to mimic iPad packaging, presumably to trick consumers into purchasing Samsung instead of Apple. Because of the well-known principle of economic activity that people never look at brand names or prices when making expensive technology purchases.
Today's proceedings were focused on explaining the contested patents to the presiding judge, presumably using the Australian versions of the PC and Mac guys. Samsung and Apple will resume the court battle proper on Thursday.

We should sue Apple over the macbook design, it looks too much like a laptop computer.
The iLovers must be jumping with joy.
"designed to mimic iPad packaging, presumably to trick consumers into purchasing Samsung instead of Apple"
Dont know what the shops are like in the rest of the world but here in the UK you dont not have shops with stacks of ipads in an isle somewhere...
You get a chained up display model you then tell the person at the checkout what you want and they go and get one from the stock room that's the first time you see the box.

lets just hope the australian judge notices this.
When are they going to start charging Apple with filing frivolous lawsuits?
God im so tired of this. If Apple had been successful during the rise of the PC there would be no competition now if they were successful with all this suing horseshit back then. YOU SHOULD NOT BE ABLE TO PATENT THE ABILITY TO TOUCH SOMETHING AND FOR IT TO RESPOND. Because it's a screen now instead of a keyboard key or a mouse button, why does that matter? You're still just touching something!! ARGHHH
I love my Macbook Pro but FU Apple, what's the matter, afraid of a little competition.
This bullshit is never going to end.
When are they going to start charging Apple with filing frivolous lawsuits?
Likely never, these are armies of lawyers behind them that likely know how to harass in court without facing any penalty. They are clearly trying to just be bullies and harass Samsung to get them out of the tablet business. If they can succeed in pulling down the product even for a short time like they did in Europe this can cause quite a loss for Samsung.
I represent an apple tree ... the apple trees are not fine with Apple`s court sue`ing actions and want to remove the license of using their image as a brand! Therefor they encourage the Cupertino base company to use a banana as a logo since they resemble a dick ... it would suit them perfectly!
Apple are really starting to piss me off.
I hope they lose. In fact I hope the tech industry team up and destroy them.
Apple seem to sue anyone who produce a decent product
I spat coffee out over my keyboard
Irony is rarely implemented well but you hit the nail right on the head

More!

Actually, Apple is the company who first created the modern laptop design with the PowerBook in 1991.

Courts already ruled against them for doing exactly that when they stole it from the Beatles
They just ignored the lawsuit and even ignored the punitive restrictions
Don't you get it?
If you have $76 billion in the bank there isn't a court in the world powerful enough to do a thing, the worst they could do is impose a fine and money is no obstacle.
What really needs to happen is for a judge to rule against Apple for a case, then when they break the ruling instead of a fine they need to drag Steve Jobs from his cancer-bed in handcuffs, charge him with contempt of court and spend 2 years in a Federal Supermax with murderers and rapists.
The lawsuits would dry up overnight, guaranteed.

Actually, the first laptops using the flip form factor appeared in the early 1980s. The Dulmont Magnum was released in Australia in 1981–82, but was not marketed internationally until 1984–85.

Typical Apple fan, claiming to have invented something 10 years after someone else already did it
...
Just like theiPad...

thank you. you made my day.
Apple's motto: If you can't innovate, litigate.
did not apple rip off star trek for the ipad, just like the ripped off xerox for the mouse.
When is a judge just going to say, "This is a waste of everyone's time, and it is a waste of money. In the interest of protecting the original purpose of patents (and the sanity of those involved), I hereby call this case closed."

did not apple rip off star trek for the ipad, just like the ripped off xerox for the mouse.
[b] Capt. Kirk, "That's mutiny Mr.!"
I thought everyone knew that Apple invented touching things
I guess it would be up to "star fleet" to litigate correct.
Trivia question. Was there ever such a thing in any Star Trek series or movie? A legal council and what was it called?
did not apple rip off star trek for the ipad, just like the ripped off xerox for the mouse.
Actually if anything they ripped off Star Trek TNG (which looks like a digital pad) which ripped off 2001 A Space Odyssey which most definitely was. A case can be made for the original series, but that looks more like pen and paper on a thick notepad than anything else and it (TOS 1966-1969) aired at about the same time as 2001 (1968). It just makes Baby Jesus cry thinking about apple trying to cripple innovation in the electronics industry. Only their zealots will buy this garbage anyways, I'm not sure if any of them have the brains to switch. If I could think of a good use for a tablet, besides just goofing around I would look at the tab, never had a bad product from Samsung yet. I wonder if apple is going to hunt down and sue Jenny Craig for making people thin?
I tend to like Samsung's argument that Apple ripped off Star Trek (TNG) and 2001: A Space Odyssey. It is a sort of "prior art."
sseyler: I agree. We need a Judge with a little backbone to kick Apple to the curb.
I guess if people are dumb enough to buy an ipad, they would be dumb enough to accidentally buy samsung because of similar packaging. See, even apple knows their customers are retarded.
They are clearly trying to just be bullies and harass Samsung to get them out of the tablet business. If they can succeed in pulling down the product even for a short time like they did in Europe this can cause quite a loss for Samsung.
Oh, boo-hoo. Poor Samsung... Dude, this is a HUGE company. They make a crap load of stuff between batteries, CD/DVDs, microchips, TVs, phones, cameras, notebooks, printers, projectors, air conditioners, washing machines, fridges, VACUUM CLEANERS! Poor, poor Samsung...
They ripped off the design big time. They deserve it.
And this is the back:

Shameless, really. I mean look at it!
PS: This website doesn't have an edit button but Tom's Hardware does (if you click "Read the comments on the forums"). Why no love for the undecided?
Didn't Samsung make most of the touchscreen panels for the iPad, and all the cpu's for the iphone's and ipad's?
Apple doesn't want anyone to see or use the Galaxy S2, because it's better than the iPhone 5, which wont be out until the Galaxy S3 is released.
hmm seems like ipad ripped off samsungs digital frame design to me... http://www.google.com/products/cat [...] 618894922#

I think you missed something here..
You see, in the pictures you provided the top one shows the Galaxy S and the iPhone 4 as the same size, but in the lower picture they are clearly different sizes, not only that but the only similarity between the two is the curved corners and camera placement. Not only that but they are different iPhones in both pictures.
Please, source your pictures PROPERLY.
Both phones are completely different.
@ DSpider
1.) Are you suggesting that Samsung copied the front of iPhone 3 but the back of iPhone 4?
2.) Galaxy S came out before iPhone 4...so in fact iPhone 4 copied Galaxy S
3.) Galaxy S is considerably larger than iPhone. In fact Apple is known to have manipulated pictures to make Galaxy S look more like iPhone...just like in the pics you posted.
