Silent Hill Writer Jailed for Vehicular Manslaughter

- By - Source : Tom's Guide US

Silent Hill writer Roger Avary has been sentenced to one year in prison and five years probation.

In January of 2008, Silent Hill and Pulp Fiction writer Roger Avary was involved in a drunk driving accident that killed fellow passenger and friend Andreas Zini, 34. Reuters reports that the newly-wed Zini and his wife Maria were in California on their honeymoon. The group was returning from dinner when Avary, traveling at 100mph, crashed his Mercedes into a telephone poll. Avary's wife was ejected from the vehicle and was seriously injured while Zini's wife was in another car and escaped unscathed.

In August of this year, Avary pleaded guilty to gross vehicular manslaughter while intoxicated and other charges stemming from the accident, a change from the not guilty plea he offered in December 2008. Avary was yesterday sentenced to one year in prison and five years probation.

Kotaku reports that Avary had already signed on to write the Silent Hill 2 movie.

Then, he realizes he's in the town of Silent Hill and meets a man named Zono who talks and looks like Zini. Avary experiences all these weird psychological events projected from his mind and he awakens to find out he killed his friend.

Silent Hill 6, coming to XBox, PC, Wii, and PS3 in June 2010.

I guess he'll be writing it from prison. I don't think there's anything that would stop him.

Is it because they're celebtrities, how do you get drunk, kill some one, and get a year in jail (or 30 days if you're Donte Stallworth)?

i wouldn't even call him a writer of silent hill, he just took the plot from the game, made some changes and put it in the movie... the movie wasn't even that great anyway, the original is still the best.

I'm confused with the story... Avary's wife? Zini's wife? He was drunk and drove into a telephone pole at 100mph... Avary's wife was ejected from vehicle and seriously injured... but Zini's wife was in another car. Where was Andreas Zini? So did Roger Avary get any injury?

He should be in for more than 1 year. Driving drunk = 1 year, driving drunk and crash no death = 2 years, driving drunk and crash with death = 10 years. Driving not drunk and crash with death = life.

Avary shouldn't have been driving period. If the other 3 adults were NOT drunk... why weren't they driving?

avary, his wife and zini where in avary's car and zini's wife was following in their car. avary was spared major injury by the safety restraint system in his luxury car, but the angle they hit the pole caused zini to be struck and crushed by the vehicle body and avary's wife was sent flying out a window.

they give these rich and 'famous' people less time than your normal joe because they're considered to be useful to society. the punishment is generally said to reflect the value of the person to society. normal people are a dime a dozen but the rich protect their own. not saying it's right but that seems to be the way it works... sad really because i'm sure zini's wife doesn't feel her husband was worth any less than avary..

"Got off easy."
Oh yes, killing your friend and severely injuring his wife while driving home drunk from a party, suffering through endless legal procedures and media exposure of the fact and then going to prison for it.

I'm sure his life is a dance on roses right about now.

But you're probably right, 25 years to life locked up with no human contact aside from hardened criminals would make him a much better person. Show him the error of his ways and really make him appreciate his dead friend.

Yes, that was sarcasm in case it didn't show.

Sad story, but I also think he should be in longer than 1 year. That does not seem like justice to me.

Quote : crashed his Mercedes into a telephone poll.

How do you crash your car into a telephone poll? Was he talking on his phone while driving? Or was he answering a poll about telephones?

Can someone check the facts on this one???

Who cares, the movie sucked anyway. I doubt the sequel will be any better, so maybe the guy that replaces him will be someone who actually played the game!

This wasn't a celeb thing as far as his sentence goes surprising enough. I also knew somebody who was drinking and driving hit and killed a little girl. He also only got one year in jail. Actually I'm surprised this guy got anything, but i guess he is only a writer so lol.

Of course the other party will wish for the maximum penalty allowed. People also sue one another for rediculous sums of money. Does this mean that it is right?

I agree, drinking and driving makes the matter more serious. However, If he had not been drinking would you feel the same way? If this guy was truely his friend then he already feels more remorse than prison time could ever give him. The real problem was that he was driving drunk, not the fact that his accident had fatalities, as tragic as it might have been.

What?
Are you trying to say, that beeing drunk is an excuse for killing somebody in car accident? Or aren't you responsible for beeing drunk?

Driving drunk should call the same consequences as a murder, regardless if anyone was hurt or not. Just because nobody did doesn't mean you didn't take the chance at taking someone's life. Everyone here knows just how irresponsible people are.

All that aside, what POS news to hear. I liked that movie. Now I get to feel guilty about considering seeing a sequel.

Seems right sentence to me the only victims were people that knew they were driving with a drunk man. If you kill somebody else on the road or in another car then yes you deserve a man/vehicle slaughter charges and a longer sentence or big fine.

Yeah he got off easy.
I'm shocked no ones brought it up yet, but why the hell was he "traveling at 100mph."

I understand that it was an accident and he'll have to live with what he did for the rest of his life, but considering the drinking I think he should get AT LEAST 4-5, and in most places 100mph and up is criminal speeding which is also a felony, maybe cali is different.

Still... imo would easily be called reckless endangerment, I can't see anything less the 6 years being fair, considering someone died.
We all know probation isnt s*** compared to prison time.
