Xbox 360 Spammed With Child Pornography

Irish police are currently investigating a case of an Xbox getting spammed with child pornography.

The Herald reports that a Dublin couple has been left shaken after being sent images of naked boys while playing online. The Irishman was playing a game via Xbox Live when he was sent an unsolicited message containing images of young boys naked from the waist down. The man and his girlfriend notified the Irish police, an Garda Síochána, and two officers were sent to investigate.

The gardaí confiscated the console and told the woman that she and her partner were right not to delete the images because if they had, and they had been found on Microsoft's mainframe, they could have been arrested for possession of child pornography.

A Microsoft spokesperson told the Herald that could not comment on the specifics of the case but added that the Xbox Live community is a "self-policing" one with a code of conduct.

I was in a game of Halo III ounce and about five or six unrelated players all got into an argument about whos town grew the best marijuana. Halfway through the match(big team battle; Avalanche)I got a picture message from one of them of a nug of weed. So my question is, who gets into weed arguments over xbox live that frequently where they'd actually be prepared to send a picture as proof? The caption for it was something like "still doubt me?"

Not a fan of capital punishment, however, when it comes to crimes against kids I make an exception...or buy an appropriately sized island and drop the sickos off.

From the article, I took it to mean that some teenager was randomly sending photos of himself and his girlfriend, not some pedophile. Regardless, should be pretty easy for M$ to find out who did this.

Sorry I couldn't help but lol at this. Ive never been on xbl or psn so I dont really know how getting unsolicited images work. Regardless I wouldn't have even opened any message from anyone I dont know irl. Isn't that intarweb common knowledge? But going back to the police issue- I cannot believe you can be prosecuted for opening up child porn inadvertently.

Me neither, it's absolutely preposterous. So they do the right thing and get the console confiscated ? Imagine it was your PC, with all your private data on it ? Would they at least let you back it up so you can work on another PC ? What if you don't have another PC ? And anyway, why are they entitled to have your Console/PC with all your data inside ? Are you allowed to delete everything from it that has nothing to do with the case ?

I mean, if someone wants to upset you, they could mail you some strange e-mail like this one from a Wi-fi spot, sitting inside the car outside, and if everytime you get to do the right thing you also get to have your Console/PC confiscated ?

What if it was a one time thing ? What if the couple thought the sender had a virus that had sent the pictures ? Are you going to bother with all the SPAM you get ?

I mean, I could denounce to authorities everytime I'm told I won the Lottery in Zimbabwe, or everytime someone tells me I'm their favoured one to get all the money from a rich man that just died with no relatives.

What I'm saying is, there has to be a line drawn somewhere. In the caseof child pornography, I agree it's more serious, but still, the person who does the right thing should not be penalised for it, nor should the person who immediately deleted the message because of feeling morally offended by it, which in any case, is a perfectly normal reaction. I mean if the person had actually solicited the message, that's entirely different, but it's not the case.

Unfortunately the cops are right (even here in the US). Becaused they opened the e-mail and saw the pics, if the couple would have deleted it and police found out, there's a chance they could be prosecuted. Is it stupid, 110% yes. Did it happen, yes it has. To the police, this is aiding a crime because you didn't report it. Ain't the law grand..../sarcasm

PS this causes the spread of porn like this because this will discourage people from reporting, would that family have reported it they knew their xbox 360 would be taken away?

Why couldn't the police just contacted microsoft and have them tell which account and which ip the porn originated from?
