How to get my photos back

My iPhone was stolen and has all of my daughters pictures are on them from birth, I don’t have any copies and need them back. I have a new phone which is connected to the same iCloud although when I try to back the system up it backs the iPad stuff not my old phone, I do not know what else to do can someone please help me? Thank you

if the phone are not back up to icloud, they are gone with the phone
